The legislation applies to businesses in England and arrangements to comply with them must be in place by 31 March 2025.

Failure to adhere to the regulations may result in action taken in line with the Environment Agency Enforcement and Sanctions Policy, which could lead to subsequent warnings, a fine, or prosecution.

Businesses have been left in the dark about how the rules work, who they apply to, and even now we don’t have clear guidance on how the rules will be enforced and what the exact penalties will be.
