Hypothetical scenario for your Friday evening.

 

You are a sub contractor (Doesnt matter what type) that has been contracted to carry out works for a MC in a school. you have been contracted under an amended JCT2016.

 

Within your contract there is a duration for the work and no start or end date. you know that some of your works are unable to commenceuntill another subbie has finished and this was discussed within the pre start meeting and minuted and has been indicated on drawings that again form part of your contract.

 

Your contract has not asked you to provide a sub contract programme. you have received a sub contract programme (several infact to date) from the MC but it is not a contract document and the programme you have received doesn't show any other sub contract activities but its start onsite date lines up with your notice to commence revcently issued and the period onsite is continuous and inline with the period within your contract.

 

You commence onsite inline with the programme and commence work as per the programme. You are informed on day 1 that the first & second work area is available but the 3rd isn't as well as a few others and are informed that a new programme will be issued. you never receive a revised programme but co-ordinate with other subbies and site team to continue working. Your a week away from running out of work and the final sections of work isnt avbailable is is a large section of the contract works, what do you do? 

You have checked your contract and allthough you stated in your price that there was a mobilisation period per visit it hasnt been included within your order and the site manager is telling you that you must commence the works anyway and is threatening to issue an NCR if you dont but is refusing to instruct you to start. The QS has told you that he isnt paying for a second set of mobilisation costs. What do you do?
